Victory for Cladding Victims: Senedd backs proposal for Bill / Buddugoliaeth i Ddioddefwyr Cladin: Senedd yn Cefnogi Cynnig ar gyfer Bil

Janet Finch-Saunders MS, Shadow Minister for Climate Change and Housing, has expressed her delight that the Welsh Parliament has backed her proposal for a Bill to ensure that high-rise building developers are responsible for safety issues.

The legislation proposed would:

a) create a duty on developers to refund leaseholders for reasonable costs accrued due to building safety issues; and

b) prohibit any developer who refuses to remediate the fire safety defects on buildings they developed from being awarded planning permission for any new developments in Wales.

Commenting after securing support from across the Welsh Parliament, the Shadow Minister said:

“There is a need to use our law-making ability to provide justice for leaseholders trapped in unsafe buildings through no fault of their own.

“It is wrong that here in Wales developers who do not remediate are still allowed to carry out major developments and gain building control sing-off.

“We must take a stand for Wales, and say NO.

“The legislative proposal that has been backed today would put in law that any developer who refuses to remediate the fire safety defects on buildings they developed would be barred from being awarded planning permission for any new developments in Wales.

“I hope that the Welsh Government Minister for Climate Change will now take my successful proposal forward, stand up for leaseholders, and stand up to developers”.

Mae Janet Finch-Saunders AS, Gweinidog Newid Hinsawdd a Thai yr Wrthblaid, wedi mynegi ei balchder bod y Senedd wedi cefnogi ei chynnig am Fil i sicrhau bod datblygwyr adeiladau uchel yn gyfrifol am faterion diogelwch.

Byddai'r ddeddfwriaeth arfaethedig yn:

a) creu dyletswydd i ddatblygwyr ad-dalu lesddeiliaid am gostau rhesymol a gronnwyd oherwydd materion diogelwch adeiladau; ac yn

b) gwahardd unrhyw ddatblygwr sy'n gwrthod datrys y diffygion diogelwch tân ar adeiladau a ddatblygwyd ganddynt rhag cael caniatâd cynllunio ar gyfer unrhyw ddatblygiadau newydd yng Nghymru.

Wrth roi sylwadau ar ôl sicrhau cefnogaeth o bob rhan o’r Senedd, dywedodd Gweinidog yr Wrthblaid:

"Mae angen defnyddio ein gallu deddfu i ddarparu cyfiawnder i lesddeiliaid sy’n gorfod byw mewn adeiladau anniogel heb unrhyw fai arnyn nhw.

"Dyw hi ddim yn iawn fod datblygwyr yma yng Nghymru sydd ddim yn datrys y broblem yn dal i gael caniatâd i gyflawni datblygiadau mawr a chael eu cymeradwyo i reoli adeiladau.

"Mae'n rhaid i ni sefyll dros Gymru, a dweud NA.

"Byddai'r cynnig deddfwriaethol sydd wedi'i gefnogi heddiw yn golygu y byddai unrhyw ddatblygwr sy'n gwrthod gwneud iawn am y diffygion diogelwch tân ar adeiladau a ddatblygwyd ganddynt yn cael eu gwahardd rhag cael caniatâd cynllunio ar gyfer unrhyw ddatblygiadau newydd yng Nghymru.

"Rwy'n gobeithio y bydd Gweinidog Newid Hinsawdd Llywodraeth Cymru nawr bwrw ati gyda fy nghynnig llwyddiannus, yn sefyll dros lesddeiliaid, ac yn sefyll i fyny i  ddatblygwyr".
