
The 16th April UK Supreme Court ruled in the case of For Women Scotland Ltd v The Scottish Ministers that the terms “sex”, “man”, and “woman” in the Equalities Act 2010 refers to biological sex, not certificated sex.
Janet Finch-Saunders, Member of the Welsh Parliament for Aberconwy, has highlighted that this will have massive implications for Wales’ public, private, and voluntary sectors.
Yesterday the Member challenged the Counsel General, Julie James MS, on what steps the Welsh Government are taking to cooperate with the Equalities and Human Rights Commission to ensure that the people of Wales have the clearest guidance possible on how to comply with this latest ruling.
Commenting on the implication of the court ruling for Wales, Janet said:
“While the Equalities and Human Rights Commission are already working on guidance on how everyone can comply with this judgement, there are massive consequences for the private, public, and voluntary sectors.
“It could be very easy for anyone to misinterpret the ruling.
“It is important that clear guidance and support is provided to people in Wales by the Welsh Government and Commission as it is through this guidance that we can ensure that safe and appropriate arrangements are made.”

Ddoe, heriodd yr Aelod y Cwnsler Cyffredinol, Julie James AS, ar ba gamau mae Llywodraeth Cymru'n eu cymryd i gydweithredu â'r Comisiwn Cydraddoldeb a Hawliau Dynol i sicrhau bod gan bobl Cymru y canllawiau cliriaf posibl ar sut i gydymffurfio â'r dyfarniad diweddaraf hwn.
Wrth sôn am oblygiadau dyfarniad y llys i Gymru, dywedodd Janet:
“Er bod y Comisiwn Cydraddoldeb a Hawliau Dynol eisoes yn gweithio ar ganllawiau ar sut y gall pawb gydymffurfio â'r dyfarniad hwn, mae goblygiadau enfawr i'r sectorau preifat, cyhoeddus a gwirfoddol.
“Gallai fod yn hawdd iawn i unrhyw un gamddehongli'r dyfarniad.
“Mae'n bwysig bod Llywodraeth Cymru a'r Comisiwn yn darparu canllawiau a chymorth clir i bobl yng Nghymru gan mai drwy'r canllawiau hyn y gallwn ni sicrhau bod trefniadau diogel a phriodol yn cael eu gwneud.”
