Calls for a Water (Wales) Bill in the Senedd / Galw am Bil Dŵr (Cymru) yn y Senedd

Following the publication of the final report by the Independent Water Commission, Janet Finch-Saunders MS/AS, Shadow Cabinet Secretary for Climate Change and Environment, has called for the introduction of a Water (Wales) Bill.

 

The publication comes at a time when it has been revealed that the number of serious pollution incidents by Dŵr Cymru has tripled since 2016. Additionally, Dŵr Cymru have recorded 155 pollution incidents, and discharged raw sewage into Welsh rivers, lakes, and seas for a total of 968,340 hours in 2024, the highest of any water company in the UK during that year.

 

Residents in Wales have also seen a water rate increase of 27%, and farmers left struggling with the requirements of The Water Resources (Control of Agricultural Pollution) (Wales) Regulations 2021. For example, Dr Susannah Bolton, Independent chair, recommended that alternatives to the closed periods be considered.

 

In response to the serious problems being encountered with water in Wales; that there has been no reporting on progress since 2016 on The Welsh Water Strategy 20215; and bearing in mind the content of the final report by the Independent Water Commission, Mrs Finch-Saunders is calling for a new Bill in the Welsh Parliament so to put all water policy related matters on a new legislative footing.

 

The Shadow Cabinet Secretary for Climate Change and Environment’s Water (Wales) Bill would include, but not be limited to:

  • Replacing Ofwat in Wales;
  • Establishing a new Flood and Water Agency for Wales which would inherit all responsibilities Natural Resources Wales have for flooding and water, act as a national system planner, direct funding, lead on producing a strategic plan, assess current conditions, and put forward a set of national objectives;
  • Creating the legal framework for a systems planner strategic board, to form part of the new Agency;
  • Delivering a new National Water Strategy to provide a 25-year, high-level view of the priorities for the water industry;
  • Requiring Welsh Government to provide strategic direction with SMART (Specific, Measurable, Achievable, Measurable and Time-bound) targets, making it easier to measure progress and hold actors accountable for delivery in the short and long-term;
  • Rationalising water industry planning down from 9 plans into 2 core planning frameworks – ‘Water Environment’ and ‘Water Supply’;
  • Reforming the water bodies classification system to ensure it presents a clear and objective assessment methodology, while driving continuous improvement and recognising progress towards overall goals;
  • Strengthening the polluter pay’s principal, and providing polluters with the option of undoing the harm caused through enforcement undertakings;
  • Requiring statutory resilience standards, covering system, infrastructure and supply chains, to be developed and adopted, so to ensure all companies make forward-looking, long-term assessments of their systems and assets and of their ability to recover from disruption to their network;
  • Strengthening the requirements on companies to map and assess the health of their assets;
  • Ensuring the new Agency has the power to block material changes in control of water companies;
  • Requiring fit and proper assessments of water company senior managers, to include consideration of integrity, propriety, and the relevance of experience for the delivery of the public goods and services that are required of water companies;
  • Scrapping the Water Resources (Control of Agricultural Pollution) (Wales) Regulations 2021, and its closed periods and costly infrastructure investments, so to introduce a scheme that works with rather than against farmers.

 

Commenting on the proposed Water (Wales) Bill, Janet said:

 

“The Commission has identified a list of over 100 pieces of legislation relevant to how water is regulated in Wales. In fact, even Natural Resources Wales has stated that much of the existing legal framework has not seen significant reviews, and in some cases has become outdated with the legal landscape contradicting the aspiration for a sustainable future. 

 

“Even the findings of a 2017 review commissioned by the Welsh Government into the legal framework for sewerage and drainage found that the current legal landscape is causing friction and unsatisfactory outcomes for consumers, businesses, and the environment.

 

“Clearly, water is in crisis in Wales, and the legislation supposed to improve standards ineffective. The Welsh Conservatives would tackle this head on with a Water (Wales) Bill. We will transform the legislative lagoon so that it’s no longer a sludgy swamp but crystal clear well for Wales.  

 

“There would need to be a white paper, public consultation, and then Committee and Senedd scrutiny, all of which could rightly influence content, but central to the reform being driven forward by me is the establishment of a Flood and Water Agency for Wales.

 

“Ofwat is not fit for the purpose. NRW is not fit for purpose. 

 

“Even the Commission recognises that NRW has a very broad range of functions, and the quango itself has admitted that they have conducted recruitment freezes and scaled back certain services. The last thing that team needs is more responsibility, so, as I have proposed in the Senedd on several occasions, I would be taking responsibilities away from them to come under the remit of the new body.

 

“Already, I have proposed a National Flood Agency for Wales. Having considered the comprehensive report by Sir Jon Cunliffe, I am convinced that the new Agency should take on responsibility for water too”.

Mewn ymateb i'r problemau difrifol gyda dŵr yng Nghymru; y ffaith nad oes unrhyw adroddiadau wedi bod ar gynnydd ers 2016 ar Strategaeth Dŵr Cymru 2015; ac o ystyried cynnwys adroddiad terfynol y Comisiwn Dŵr Annibynnol, mae Mrs Finch-Saunders yn galw am Fil newydd yn y Senedd er mwyn rhoi’r holl faterion sy’n ymwneud â pholisi dŵr ar sail ddeddfwriaethol newydd.

 

Byddai Bil Dŵr (Cymru) Ysgrifennydd Cabinet yr Wrthblaid dros Newid Hinsawdd a'r Amgylchedd yn cynnwys, ond heb fod yn gyfyngedig i:

-          Ddisodli Ofwat yng Nghymru;

-          Sefydlu Asiantaeth Llifogydd a Dŵr newydd i Gymru a fyddai'n etifeddu holl gyfrifoldebau Cyfoeth Naturiol Cymru ar gyfer dŵr a llifogydd, yn gweithredu fel cynllunydd systemau cenedlaethol, yn cyfarwyddo cyllid, yn arwain ar lunio cynllun strategol, yn asesu amodau presennol ac yn cyflwyno set o amcanion cenedlaethol;

-          Creu'r fframwaith cyfreithiol ar gyfer bwrdd strategol cynllunydd systemau, i fod yn rhan o'r Asiantaeth newydd;

-          Cyflwyno Strategaeth Ddŵr Genedlaethol newydd i ddarparu darlun 25 mlynedd, lefel uchel o'r blaenoriaethau ar gyfer y diwydiant dŵr;

-          Gofyn i Lywodraeth Cymru ddarparu cyfeiriad strategol gyda thargedau CAMPUS (cyraeddadwy, amserol, mesuradwy, penodol, uchelgeisiol, synhwyrol), gan ei gwneud hi'n haws mesur cynnydd a dwyn pobl i gyfrif am gyflawni yn y tymor byr a'r tymor hir.

-          Rhesymoli cynlluniau’r diwydiant dŵr i lawr o 9 cynllun i 2 fframwaith cynllunio craidd – 'Amgylchedd Dŵr' a 'Cyflenwad Dŵr’;

-          Diwygio'r system dosbarthu cyrff dŵr i sicrhau ei bod yn cyflwyno methodoleg asesu glir a gwrthrychol, gan sbarduno gwelliant parhaus a chydnabod cynnydd tuag at nodau cyffredinol;

-          Cryfhau'r 'egwyddor mai’r llygrwr sy’n talu' a rhoi opsiwn i lygrwyr ddadwneud y niwed a wnaed trwy ymrwymiadau gorfodi;

-          Ei gwneud yn ofynnol i safonau cadernid statudol, sy'n cwmpasu system, seilwaith a chadwyni cyflenwi, gael eu datblygu a'u mabwysiadu, er mwyn sicrhau bod pob cwmni’n gwneud asesiadau hirdymor blaengar o'u systemau a'u hasedau a'u gallu i adfer wedi achos o darfu ar eu rhwydwaith;

-          Cryfhau'r gofynion ar gwmnïau i fapio ac asesu iechyd eu hasedau;

-          Sicrhau bod gan yr Asiantaeth newydd y grym i rwystro newidiadau materol mewn rheolaeth cwmnïau dŵr;

-          Gofyn am asesiadau addas a phriodol o uwch reolwyr cwmnïau dŵr, i gynnwys ystyriaeth o uniondeb, priodoldeb a pherthnasedd profiad ar gyfer darparu'r nwyddau a'r gwasanaethau cyhoeddus y mae’n ofynnol i gwmnïau dŵr eu darparu;

-          Dileu Rheoliadau Adnoddau Dŵr (Rheoli Llygredd Amaethyddol) (Cymru) 2021, a'u cyfnodau gwaharddedig a'u buddsoddiadau costus mewn seilwaith, er mwyn cyflwyno cynllun sy'n gweithio gyda ffermwyr yn hytrach nag yn erbyn ffermwyr.

 

Wrth sôn am y Bil Dŵr (Cymru) arfaethedig, dywedodd Janet:

 

“Mae'r Comisiwn wedi nodi rhestr o gant a mwy o ddarnau o ddeddfwriaeth sy'n berthnasol i sut mae dŵr yn cael ei reoleiddio yng Nghymru. Mewn gwirionedd, mae hyd yn oed Cyfoeth Naturiol Cymru wedi dweud nad yw llawer o'r fframwaith cyfreithiol presennol wedi cael ei adolygu'n sylweddol ac, mewn rhai achosion, ei fod wedi dyddio, gyda'r dirwedd gyfreithiol yn gwrth-ddweud yr uchelgais am ddyfodol cynaliadwy.

 

“Mae hyd yn oed canfyddiadau adolygiad 2017 a gomisiynwyd gan Lywodraeth Cymru o'r fframwaith cyfreithiol ar gyfer carthffosiaeth a draenio yn dangos bod y dirwedd gyfreithiol bresennol yn achosi gwrthdaro a chanlyniadau anfoddhaol i ddefnyddwyr, busnesau a'r amgylchedd.

 

“Mae'n amlwg bod y diwydiant dŵr mewn argyfwng yma yng Nghymru, a bod y ddeddfwriaeth sydd i fod i wella safonau yn aneffeithiol. Byddai'r Ceidwadwyr Cymreig yn mynd i'r afael â hyn gyda Bil Dŵr (Cymru). Byddwn yn trawsnewid y lagŵn deddfwriaethol fel nad yw'n gors slwtshyd mwyach ond yn ffynnon gwbl glir i Gymru. 

 

“Byddai angen papur gwyn, ymgynghoriad cyhoeddus, a phroses graffu ar lefel Pwyllgor a'r Senedd - a gallai pob un ohonynt ddylanwadu ar y cynnwys - ond elfen ganolog o'r diwygio sy'n cael ei ysgogi gennyf fi yw sefydlu Asiantaeth Llifogydd a Dŵr i Gymru.

 

“Nid yw Ofwat yn addas i'r diben. Nid yw Cyfoeth Naturiol Cymru yn addas i'r diben.

 

“Mae hyd yn oed y Comisiwn yn cydnabod bod gan CNC ystod eang iawn o swyddogaethau, ac mae’r cwango ei hun wedi cyfaddef ei fod wedi gorfod rhoi’r gorau i recriwtio mwy o staff a chwtogi ar wasanaethau penodol. Y peth olaf sydd ei angen ar y tîm yw mwy o gyfrifoldeb, felly, fel rwyf wedi’i gynnig yn y Senedd ar sawl achlysur, byddwn yn cymryd cyfrifoldebau oddi arnynt i ddod yn rhan o gylch gwaith y corff newydd.

 

“Rwyf eisoes wedi cynnig Asiantaeth Llifogydd Genedlaethol i Gymru. Ar ôl ystyried yr adroddiad cynhwysfawr gan Syr Jon Cunliffe, rwy'n argyhoeddedig y dylai'r Asiantaeth newydd ysgwyddo'r cyfrifoldeb am faterion dŵr hefyd”.
