Assisted Dying Legislation Passes Vote in Senedd / Deddfwriaeth marw â chymorth yn pasio pleidlais yn y Senedd

Following yesterday’s passionate debate, the Senedd voted in favour of granting legislative consent to Westminster’s Assisted Dying Bill.

 

If the bill passes Royal Assent, it will create a legal pathway for assisted dying services in England and Wales. As a result of the Senedd’s vote, these services would also be made available through the Welsh NHS.

 

If the Senedd had voted against the bill then this would have meant assisted dying services would only have been offered privately in Wales.

 

The debate was passionate and respectful with the Presiding officer allowing the debate to continue longer than the allocated time, thereby giving the appropriate time for those members wishing to speak, to do so.

 

Janet Finch-Saunders, Senedd Member for Aberconwy said:

“Yesterday’s debate in the Senedd was one of the most passionate and respected ones that I have ever took part as a member of the Senedd.

 

I have had many deeply passionate and emotional emails and correspondence with constituents regarding this matter and yesterday we gave the debate the respect it deserved.

 

I believe the vote came along too early in the legislation process. Especially, given the timing. This Private Members Bill has already missed out on earlier, expert witness evidence being provided. And the bill is still going through the House of Lords, with over 1,000 amendments yet to be debated. It then returns to the UK Parliament for further scrutiny and deliberations.

 

As the Senedd, I believe we should only vote on completed and passed legislation, due to the fact that the legislation could look a lot different after all those amendments had been debated and conclusions drawn”

 

I fear the LCM having passed last night may lead to a slippery slope in terms of due process and I do not wish to see other examples of this going forwards.”

 

Yn dilyn y ddadl angerddol ddoe, pleidleisiodd y Senedd o blaid rhoi cydsyniad deddfwriaethol i Fil Marw â Chymorth San Steffan.

 

Os bydd y bil yn pasio Cydsyniad Brenhinol, bydd yn creu llwybr cyfreithiol ar gyfer gwasanaethau marw â chymorth yng Nghymru a Lloegr. O ganlyniad i bleidlais y Senedd, byddai'r gwasanaethau hyn hefyd ar gael drwy GIG Cymru.

 

Pe bai'r Senedd wedi pleidleisio yn erbyn y bil yna byddai hyn wedi golygu y byddai gwasanaethau marw â chymorth wedi cael eu cynnig yn breifat yn unig yng Nghymru.

 

Roedd y ddadl yn angerddol ac yn barchus gyda'r Llywydd yn caniatáu i'r ddadl barhau yn hwy na'r amser a neilltuwyd, gan roi'r amser priodol i'r aelodau hynny a oedd yn dymuno siarad, i wneud hynny.

 

Meddai Janet Finch-Saunders, yr Aelod o’r Senedd dros Aberconwy:

"Roedd y ddadl ddoe yn y Senedd yn un o'r rhai mwyaf angerddol a pharchus i mi gymryd rhan ynddi erioed fel aelod o'r Senedd.

 

Rwyf wedi cael llawer o negeseuon e-bost a gohebiaeth angerddol ac emosiynol iawn gan etholwyr ynglŷn â'r mater hwn a ddoe fe wnaethom ni roi'r parch dyledus i'r ddadl.

 

Rwy'n credu bod y bleidlais wedi dod yn rhy gynnar yn y broses ddeddfwriaeth. Yn enwedig o ystyried yr amseru. Mae'r Bil Aelodau Preifat hwn eisoes wedi colli allan ar dystiolaeth gan dystion arbenigol yn gynharach yn y broses. Ac mae'r bil yn dal i fynd trwy Dŷ'r Arglwyddi, gyda dros 1,000 o welliannau eto i'w trafod. Yna, bydd yn dychwelyd i Senedd y DU ar gyfer craffu a thrafodaethau pellach.

 

Fel Senedd, credaf y dylem bleidleisio ar ddeddfwriaeth sydd wedi'i chwblhau a'i phasio yn unig, oherwydd gallai'r ddeddfwriaeth edrych yn llawer gwahanol ar ôl i'r holl welliannau hyn gael eu trafod ac i’r casgliadau gael eu gwneud."

 

Rwy'n ofni y gallai'r Cynnig Cydsyniad Deddfwriaethol a basiwyd neithiwr arwain at lethr llithrig o ran y drefn briodol, a dydw i ddim am weld enghreifftiau eraill o hyn yn y dyfodol."
